POSB PAssion Run for Kids 2013 Instagram Competition (“Competition”) will be held from 25 March 2013 to 30 April 2013. The submissions for the Competition will start from 09:00 25 March 2013 and end at 23:59 on 30 April 2013. The act of entering the Competition constitutes acceptance of these Terms and Conditions. 1. Each participant represents and warrants that the Materials submitted in the Competition (whichever is applicable) are the participant’s original work and that it does not infringe the intellectual property rights (including without limitation any patents, trade marks, service marks, registered designs, applications for any of the foregoing, copyright, design rights, know-how, confidential information, trade and business names and other similar protected rights in any country) of any third party. 2. All Materials shall become the sole and exclusive property of DBS. DBS shall own and have the sole and exclusive right to use, copy, distribute, translate, modify, display and prepare derivative works of entries, as well as the right to authorize such uses by others. DBS shall have the right to obtain and to hold in its own name, copyrights, registrations or other such protection as may be appropriate, and any extensions and renewals thereof. Participants shall, if requested by DBS, assign all intellectual property rights to DBS by executing documents pertaining to such assignment and/or to do all such things necessary to perfect and effect the assignment, and any cost incurred thereof shall be borne by the participant. 3. DBS will not be held liable for any copying, re-posting or unlawful inappropriate, indecent, obscene, hateful, defamatory, slanderous or libellous content; and content that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age. 1. DBS Bank Ltd (“DBS”) will select and upload on for the period from 25 March to 30 Apr 2013. These weekly winners (“Weekly Winners”) will each receive an exclusive Smiley Plush toy and a cash prize of S$20 . Each Weekly Winner will be notified via an Instagram comment on their winning picture. 2. There will be a total of twenty-four (24) Weekly Winners. One grand prize winner will be selected from the Weekly Winners. The grand prize winner will receive a cash prize of S$200.00. 3. Results will also be published on the DBS Facebook fan page. All prizes must be claimed within 1 month from the date of notification. 4. DBS reserves the right to select reserve winners to replace any 1. DBS shall not be obliged to enter into any correspondence with any participant on any matter relating to the Competition. 2. By participating in the Competition, all participants agree to release and hold harmless DBS from any and all liability whatsoever for any injuries, losses or damages of any kind to any person or property arising from or in connection, either directly or indirectly, with the following: i. the awarding, acceptance, receipt, possession, use or misuse of any of the prizes or parts thereof awarded pursuant to the Competition; or ii. the participation in the Competition, or any prize-related activities including without limitation, any error in computing any breakdown, or malfunction of any computer system or equipment. 4. The following will result in the disqualification of entries and may result, if discovered after the award of the prize, in the revoking of the prize. Participants agree that the list below is not exhaustive: i. Submission is received after the closing date; ii. Submission fails to comply with the entry procedure iii. Materials that had previously won an award in another competition or one that has been announced as the winner of an award; iv. Materials that are the same as or similar to that already v. Materials that infringe on copyright, industrial property right, intellectual property right or other rights of any other photographs, artworks, statements and/or ideas; vi. Materials banned from exhibition or publication; vii. Any of these Terms and Conditions are breached or viii.Any entry that does not meet any of the criteria of the ix. Any submission with invalid, incorrect, inaccurate or x. Where an attempt is made to subvert the letter and/or spirit xi. Where the participant is found to be tampering with the entry process or the operation of the Competition or is seen to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or xii. Where the entry contains obscene, racist, unethical, dangerous, violent, politically motivated, sexual inference or legally objectionable material, or material that may infringe upon any person’s personal or property rights. 5. In opening an Instagram Account and using any services, products or features of Instagram for the purposes of the Competition (including without limitation, uploading the photographs onto Instagram), each participant is fully liable and responsible for complying with all terms and conditions as may be imposed by Instagram for the Instagram Account and its usage, and DBS shall not be liable in any way whatsoever for such Instagram Account and its usage. Each participant further agrees to fully indemnify DBS for all losses, damages, expenses, claims, fees (including legal fees on a full indemnity basis), monies, costs and liabilities incurred by DBS as a result of or in connection with such participant opening a Instagram Account and using any services, products or features of Instagram for the purposes of this Competition. 6. By participating in the Competition, each participant authorizes DBS to disclose to any party (including Instagram), any particulars of that participant as DBS may consider necessary, for the purposes of the Competition. 7. Acceptance of the prize constitutes permission for DBS, its advertising and promotional agencies to use any of the winner’s names and/or likeness for advertising and promotional purposes without additional compensation unless prohibited by law. 8. In the event of any inconsistency between these Terms and Conditions and any brochure, marketing or promotional material relating to the Competition, these Terms and Conditions will prevail. 9. These Terms and Conditions shall be governed by Singapore law and the participants agree to submit to the exclusive jurisdiction of the courts of Singapore. 10. A person who is not a party these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these Terms and Conditions and notwithstanding any terms herein, the consent of any third party is not required for any variation (including any release or compromise of any liability) or termination of these Terms and Conditions. Your comments are public and available to anyone visiting the DBS Facebook page and on Instagram.  DBS does not have any obligation to monitor, edit, or review any postings on this page.DBS disclaims all responsibility or liability arising from the content of any such postings including for any error, defamation, falsehood, obscenity, profanity, or inaccuracy contained therein.  You are solely responsible and liable for your communications and submissions (and the consequences) made under your name, user name, email address, password and your registration and profile information, if any. Your posting will be treated as non-confidential and non-proprietary. DBS will fully cooperate with any law enforcement and government authorities and any judicial or regulatory orders requesting copies of or information in relation to any postings or content.  We may amend this Policy from time to time and will place any such amendments on this page. #posbpassionrun, you accept the terms and conditions herein, and undertake to indemnify DBS in full against all expenses, fees, costs (including legal costs on a full indemnity basis), claims and liabilities incurred or suffered by DBS arising out of or in connection with any posting made by you or the content thereof.
